NCP Birmingham Airport Valet Parking Terms and Conditions
Please read these terms carefully as they will form part of the contract between you and NCP in relation to the provision of the Valet Parking service. We recommend that you retain a copy of these Terms & Conditions in a safe place as they form part of the contract between us.
1. Application of these Valet Parking Terms & Conditions
These Valet Parking Terms & Conditions apply to and will form part of the Pre-Book Terms and Conditions for your Booking for a Valet Parking service at a Car Park.
2. Definitions
In these Valet Parking Terms & Conditions:
NCP, we, us and our shall be a reference to National Car Parks Limited and each other operating company in the NCP group of companies (including National Car Parks Manchester Limited);
you, your and customer means a person who has entered into a contract with us for the Valet Parking service;
Booking means your booking for the Valet Parking services at the Nominated Car Park made:
(a) through www.ncp.co.uk;
(b) through our corporate partners and affiliates (such as our travel agent partners) or their websites; or
(c) by telephone through our Customer Contact Centre on 0345 050 7080;
Car Park Terms and Conditions means the general car park terms and conditions relating to use of the Nominated Car Park and which form part of (and are deemed to be incorporated in) these Valet Parking Terms & Conditions and are displayed at the Nominated Car Park and are accessible here;
Nominated Car Park means the Car Park specified in your Booking and to which the Booking relates;
our representative means any of our officers, employees and agents (acting in the course of business and within the scope of their duties towards us);
Valet Parking Terms & Conditions means these terms and conditions (including the Car Park Terms and Conditions);
Valet Parking Reception Area means the area provided for the operation of the valet parking service; and
Vehicle means any vehicle used to convey passengers or items that enters into the Nominated Car Park including any mechanical device on wheels or tracks, its equipment, accessories and everything that may be left in or on it.
3. Your Rights and Responsibilities
3.1 When at the Valet Parking Reception Area, you must drive carefully and responsibly. You must also ensure that any children and animals are properly supervised and are at all times accompanied when they are at the Valet Parking Reception Area. Please take care to be aware of all Vehicles in motion within the Valet Parking Reception Area.
When you have parked your Vehicle in the Valet Parking Reception Area, it is your responsibility to:
3.2.1 lock your Vehicle securely;
3.2.2 fully close all windows of your Vehicle;
3.2.3 apply your handbrake properly;
3.2.4 not leave any animal or person within your Vehicle;
3.2.5 remove any valuables from your Vehicle;
3.2.6 ensure that your possessions are placed in a locked boot and are not on display.
We cannot be held responsible for any loss or damage whatsoever occurring to your Vehicle or possessions within it resulting from your failure to do these things. We do not accept any valuables or other articles for safe custody.
3.3 You must comply with all directional signage and other instructions given by our representatives when in the Valet Parking Reception Area.
3.4 You should ensure that you leave with us only your ignition key, the key to your driver’s door and the key for any security or immobilisation device fitted to your Vehicle. We accept no liability for any loss or damage suffered by you to your Vehicle where you leave other keys with us.
3.5 By leaving your Vehicle with us, you warrant that (at all times while in our custody) the Vehicle is roadworthy, has a valid MOT, that its Vehicle tax is current and paid and is properly insured so as to comply with all relevant legislation in the United Kingdom. You hereby indemnify us in respect of all claims, losses, damages, costs and expenses suffered by us arising from any breach of this warranty. You accept liability for all harm suffered by third parties as a result of any breach of this warranty.
3.6 If you have also booked a car wash as part of the Valet Parking service you must:
3.6.1 disclose to us all damage, marks, defects or weaknesses (including any old or non-original paintwork) to your Vehicle which may be affected by the cleaning process when you drop off your Vehicle; and
3.6.2 use caution when collecting your Vehicle as polish and other cleaning products can be slippery.
3.7 For the avoidance of doubt, clause 12 of NCP’s Car Park Terms and Conditions (Abandoned Vehicles) will apply if you fail to collect your Vehicle more than 28 days after the date which you have specified for exit in the booking.
4. Our Responsibilities and Liability
4.1 We are responsible for ensuring that your Vehicle is driven carefully by us between the Valet Parking Reception Area and the Nominated Car Park; that any car wash service (if purchased) is completed with reasonable care and skill; and that we and our representatives are insured for any loss or damage to your Vehicle which occurs as a result of our negligence.
4.2 We will pay to you the reasonable cost of repairing any damage to your Vehicle which is caused by the negligent driving of our representatives while they are providing the Valet Parking service, but the aggregate liability of us to you shall be limited to £50,000 (fifty thousand pounds).
4.3 Except as set out in this clause 4, we do not accept liability for damage to your Vehicle (whether caused accidentally or by way of vandalism) while the Vehicle is in the Nominated Car Park or in the Valet Parking Reception Area.
4.4 We do not accept liability for theft of or from your Vehicle unless you have entrusted the keys of the Vehicle to us and then only provided that the keys have been used in order to carry out the theft.
4.5 If you purchased a car wash as part of your Valet Parking service we do not accept liability for:
4.5.1 any and all pre-existing damage, marks or defects on your Vehicle (including where such damage, marks or defects were discovered and/or revealed as part of the cleaning process); and/or
4.5.2 damage caused as part of the cleaning process due to old or non-original paintwork or the fact that your Vehicle is over 3 years old (as older Vehicles may have weaker materials and plastics).
